GENERAL TERMS & CONDITIONS OF THE CU-LJUBLJANA.COM (ONLINE STORE)

cu-ljubljana.com is an online store of the Provider VMN šport d.o.o. The business conditions have been drawn up taking into account all legal obligations and international guidelines for e-commerce, represented by the Slovenian Consumers’ Association (ZPS).

Products available at retail stores are usually also available in an online store where the Consumer can redeem purchases with additional discounts and promotions. The listed online prices apply specifically to online purchases. Stocks of items in the online store do not necessarily mean physical stock in the retail store. The online product line also includes products that are not available in the retail store.

SIGN-UP

When registering in an online store, the Consumer obtains a username that is identical to his or her email address and a password which the Consumer creates. The Consumer’s username and password are uniquely determined and linked to the completed data. After registration, the Consumer becomes a user and acquires the right to purchase. These general terms and conditions are being considered for the operation of online store cu-ljubljana.com, user rights and business relationship between Provider and Customer.

ACCESSIBILITY OF INFORMATION

The Provider VMN šport d.o.o. undertakes to always provide the Consumer with the following information:

  • the identity of the Provider (company name and registered office, tax number)

  • Provider contact information that enables quick and effective communication (e-mail, phone number)

  • essential characteristics of goods or services (including after-sales services and warranties)

  • the availability of products (any product or service offered on the website is generally available within a reasonable time)

  • terms of delivery of the product or service execution (manner, place and deadline of delivery)

  • all prices are in euro and clearly and unequivocally determined, it must be shown whether they already contain taxes and shipping costs

  • method of payment and delivery

  • time validity of the offer

  • a time limit within which it is still possible to withdraw from the contract; moreover, if and to what extent the Consumer returns the product

  • the complaint procedure must be clarified, including all contact details of the contact person or the customer service department

THE RIGHT TO WITHDRAW FROM THE PURCHASE AND TO RETURN THE PRODUCT

100% PURCHASING GUARANTEE. Online store cu-ljubljana.com enables the return of ordered goods in the cu-ljubljana.com web store within 14 days of receipt or delivery of the purchased item(s) and guarantees the Consumer’s refund.

The option of withdrawal is provided in accordance with the Consumer Protection Act. In the case of distance contracts, each Consumer has the right, within 14 days of the purchase, to notify the Provider in writing that they rescind the contract without having to state the reason for his or her decision. A withdrawal declaration shall be deemed if the Consumer sends the withdrawal within the time limit set for the withdrawal from the contract (2nd paragraph of article 43 of the ZVPot.)

Before returning items purchased at the cu-ljubljana.com web-shop, the Consumer should notify the Provider by phone: +386 40 576 007 or by e-mail info@cu-ljubljana.com or in writing by post to the address of the Provider, so the most appropriate solution for the return of purchased goods is agreed upon.

The total cost of sending and/or returning goods is borne by the Consumer. In the event of withdrawal, the Provider immediately or no later than 14 days after receipt of the notice of withdrawal, will refund all the received payments.
The Provider shall return received payments to the Consumer with the same payment method as the Consumer used, unless the Consumer explicitly requested the use of another means of payment and if the Provider does not bear any costs.
In the case of online sales, the Provider may refrain from refunding received payments until the goods are returned to the Provider or until the Consumer has provided evidence that the goods have been sent back or if the Provider offers to collect the returning goods.

If the Consumer has received inadequate or damaged goods, the Consumer can return it within the statutory deadline of 14 days after receiving the goods, and the goods must be unused, packed in original packaging and intact.

The Consumer of ordered goods under the aforementioned conditions cannot return items in the following cases:

  • if it has opened the security seal and/or the article has been unpacked from the original packaging (ZVPot, Article 43.č)

  • if a label that protects the product from unauthorized service is damaged

  • if the product is made and customized according to the instructions of the Consumer and is adapted to their needs

FAULTY GOODS

When are goods considered faulty? When:

  • the product does not have the characteristics necessary for its normal use or for marketing

  • the product does not have the features that are needed for the particular use for which the Consumer buys it, but which the Provider was familiar with

  • the product has no qualities and distinctions that were expressly or silently agreed or prescribed

  • the Provider has delivered a product that does not match the pattern or model unless the sample or model was shown only because of notifications

How is the suitability of the product checked?

The suitability of the product is checked with another flawless product of the same type, as well as with the statements of the manufacturer or indications on the item itself.

How to claim the faulty goods?

The Consumer must inform the Provider of any material error, together with the exact description of this and at the Consumer’s own expense within the statutory deadline. At the same time, the Consumer allows the Provider to review the item.

The right to claim faulty goods is more precisely regulated by the provisions of the Consumer Protection Act.

WARRANTY AND SERVICE

PThe manufacturer is obliged, in accordance with the law, to provide the Consumer with a guarantee for the proper functionality of the purchased goods. The Consumer can claim the guarantee directly from the manufacturer or their authorized service centre.

The Consumer can also enforce the guarantee with the Provider, but also, in this case, the provision from the previous paragraph applies.

All items have a warranty of at least 1 month or as indicated on the warranty or invoice. The warranty is valid only with respect to the manuals, alongside the certified warranty and the invoice. The warranty period is stated on the warranty card or invoice. The warranty information is also presented on the product presentation page. If there is no warranty information, it is considered that the item has no warranty or information is not known at this time. In this case, the Consumer can contact the Provider who will provide up-to-date information.

For the service claim of a product whose authorized service Provider is not VMN šport d.o.o., the Provider takes the role of intermediary and that the product cannot be serviced at VMN šport d.o.o., but must be serviced at an authorized service centre.

The Consumer can hand over the product at the Provider’s shop. In this case, the Provider will send the item to the authorized service, which is listed on the warranty list of the product. Pursuant to Article 20 of the ZVPot, the acceptance of the product is considered as a complaint when it arrives in an authorized service. Shipping to an authorized service from VMN šport d.o.o. stores is performed once a week.

The Provider VMN šport d.o.o. cannot give the Consumer information about the service updates.

In accordance with Article 20 of the Consumer Protection Act, VMN šport d.o.o. is not liable for any delay of 45 days or for irregularities in the repair. The 45-day period begins to run when the item is accepted at an authorized service and not when it was submitted to the Cycling United Ljubljana store.

For all detailed information, for this reason, it is necessary to contact an authorized repairer, and not VMN šport d.o.o., which is merely an intermediary between the Consumer and the authorized service centre.

PAYMENT

The Provider issues an invoice, with broken down costs and a notice to the Consumer, how to withdraw from the purchase, and how to return the products. The Consumer can pay for the products ordered at the cu-ljubljana.com online store with payment cards (Mastercard, Visa and Maestro) or by transfer to VMN šport d.o.o. (on offer/pro forma invoice).


Payment with Diners Club card is not possible in the cu-ljubljana.com online store. For this kind of payment visit the Provider at Cycling United Ljubljana at Dobrunjska cesta 62, 1261 Ljubljana-Dobrunje.

DELIVERY TIME

For goods in stock, delivery of goods is 2-5 working days, and in other cases up to 14 days. For products the Provider does not have in stock, the delivery time is up to 14 days after the order has been received. In the case of a longer delivery deadline, the Provider will notify the Consumer by e-mail or by phone.

DELIVERY

The Provider must deliver the goods or services at the agreed time. Upon the delivery, it shall provide the Consumer with additional information regarding the right of withdrawal, in particular, the conditions and manner of executing the right. It must provide all the necessary information regarding the address to which the Consumer may contact regarding the complaint and information about guarantees and services or other services after the conclusion of the contract.

OPTIONS AND COST OF DELIVERY:

  1. Delivery of orders with regular delivery of up to EUR 200,00 amounts to EUR 4,20 (on the territory of the Republic of Slovenia.)
  2. Orders worth more than EUR 200,00 with regular delivery are free (on the territory of the Republic of Slovenia.)
  3. Free personal pick-up at the Cycling United Ljubljana store on Dobrunjska cesta 62, 1261 Ljubljana-Dobrunje. When the Consumer’s order is ready for collection, the Provider will notify the Consumer by email. The order can be picked up during office hours, Monday to Friday, between 12pm and 6pm (Saturdays, Sundays and public holidays closed.)
  4. Fast delivery is available the same day on the route Ljubljana – Kranj. For agreement and price, the Consumer can contact the Provider before submitting their order.
  5. In the case of delivery outside of the Republic of Slovenia, the Consumer can contact the Provider, as in this case the Provider prepares an offer that includes postage to the Consumer’s destination.

Delivery of ordered products during the working week from Monday to Friday is as indicated by the product information provided at the online store.

VALIDITY OF THE OFFER

When buying, the prices apply at the time of order confirmation. All prices are listed in euros and contain VAT except used items for which the VAT is charged on the basis of Article 101, paragraph 1 item 2, and Article 104. ZDDV-1, pursuant to Article 110 ZDDV-1 on the account is disclosed. Prices in the online store can be changed without prior notice. The pictures can only be symbolic and do not always reflect the actual situation.

The Provider apologizes for any errors in advance.

SAFETY

The Provider uses appropriate technological and organizational means to protect the transmission and storage of personal data, orders and payments.

PROTECTION OF PERSONAL DATA

cu-ljubljana.com undertakes to permanently protect all personal data of the Consumer in accordance with ZVOP-1.

cu-ljubljana.com keeps the following data of cu-ljubljana.com members for an indefinite period of time: name and surname, e-mail address, contact phone number, primary address and delivery address, country of residence, time and date of registration and archive of communication with cu- ljubljana.com.

cu-ljubljana.com uses the listed personal data exclusively for the purpose of fulfilling the order (sending information material, offers, accounts) and communication with the member.

In no case shall the Consumer’s information be handed over to unauthorized persons.

For guests of cu-ljubljana.com the personal data is stored only for the time until the order is fulfilled. The following data is stored: name and surname, e-mail address, contact phone number, primary address and delivery address, country of residence, time and date registration and archive of communication with cu-ljubljana.com. After the order has been fulfilled, only information relating to an individual order is retained, which can only be accessed through knowledge of the account number and the order number.

In order to protect personal data, the Consumer is also responsible for ensuring the security of his or her email address, username and password, and the appropriate software (antivirus) protection of his or her computer.

COMMUNICATION

The Provider may contact the Consumer via means of distance communications only if the Consumer does not explicitly oppose.

ARCHIVE OF CONTRACTS

The contract concluded between the Provider and the Consumer is permanently stored at VMN šport d.o.o., Struževo 3D, Kranj, 4000 Kranj.

Advertising electronic messages must include the following components:

  • they must be clearly and unambiguously marked as advertising messages
  • the sender must be clearly visible
  • various campaigns, promotions and other marketing techniques must be designated as such
  • the Consumer’s wish not to receive promotional messages should be respected

COMPLAINTS

The Provider respects the applicable Consumer protection law. The Provider must establish an effective complaint handling system and identify the person with whom, in case of problems, the Consumer can connect by phone or by email. The complaint procedure must be available on the website, easy to use and confidential. Within five working days, the Provider must acknowledge receipt of the complaint, inform the Consumer how long it will be handled and keep him or her informed about the progress of the procedure. The Provider is aware that the essential characteristic of the Consumer dispute, at least in terms of judicial resolution, is the disproportion between the economic value of the claim and the costs arising in the resolution of the dispute itself. This is also the main obstacle for the Consumer not to initiate a dispute before a court. Therefore, the Provider strives to do his or her best to resolve any dispute by mutual consent.
